Terms of Use
1. Use

Pentos AG grants you the right to download trial versions of the MailCommander Toolkit (Migration and Administration) to your computer.
You are hereby advised that the software offerings are only trial versions which have not yet been fully tested by Pentos AG. Upon ordering, you will be sent full versions of the products.

2. Scope of use

The trial versions may only be tested and used in a testing environment, i.e. an IT infrastructure without storage of any business-related documents.
You are not authorized to make any changes, modifications and/ or adaptations to the software, in particular any programming changes. You are furthermore not authorized to copy, distribute or publish the software and/or to make it available to third parties. Pentos AG will prosecute all violations to the full extent of civil and criminal law.

3. Liability

3.1. Malicious intent and gross negligence
Pentos AG is liable in accordance with the applicable legal regulations for damages caused by willful or grossly negligent breach of contractual obligations.

3.2. Slight negligence
Pentos AG shall only be liable in cases of slight negligence subject to breach of material contractual obligations. Liability for breach of material obligations is limited to characteristically and contractually foreseeable damages.

3.3. All others cases
All other damage claims against Pentos AG are excluded, in particular damages arising from not using the software in a testing environment in violation of Article 2.

4. Copyright

As author of the software, Pentos AG has and retains legal ownership of all copyright and usage rights to the software provided to you, even should you illicitly modify the software and/ or link it to your own or third-party programs.
As author, Pentos AG has the sole and exclusive right to modify, distribute and/ or derive benefit from the software.
